1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you and Mishigo OU, an Estonian private limited company ("Trivia Gorilla," "we," "us"), governing your access to and use of the Trivia Gorilla mobile app, website, and related services (the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may only use the Service with permission from a parent or legal guardian who agrees to these Terms on your behalf.

3. Accounts

  • You may create an account using an email and password, or by signing in with Google or Apple.
  • You agree to provide accurate information and to keep your credentials confidential.
  • You are responsible for activity that takes place under your account.
  • We may suspend or terminate accounts that violate these Terms, attempt to manipulate scores or leaderboards, or pose a security risk.

4. Account Deletion

You can delete your account at any time from inside the app (Account → Delete Account). Deletion removes your personally identifying information, linked sign-in providers, sessions, and profile data. Historical quiz attempts are retained in anonymized form so that leaderboard rankings remain stable, but are no longer linked to your identity. See our Privacy Policy for full detail.

5. Acceptable Use

You agree not to:

  • Use bots, scripts, emulators, or any automated system to play quizzes, submit scores, or scrape content.
  • Attempt to manipulate leaderboards, daily-challenge results, or any other scoring mechanism, including by reverse-engineering API endpoints to submit fake attempts.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service, except to the extent expressly permitted by applicable law.
  • Probe, scan, or test the vulnerability of the Service or breach any security measures.
  • Harass, threaten, or impersonate other users, employees, or third parties.
  • Use the Service to violate any law or regulation.

6. AI-Generated Content

Some trivia questions on Trivia Gorilla are generated with the help of artificial intelligence and reviewed before publication. While we work hard on accuracy, AI-generated content may occasionally contain errors. Quiz content is provided for entertainment and informational purposes only and should not be relied on as authoritative. If you spot an error, please flag the question in-app.

7. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trivia content, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

8. Purchases and Subscriptions

The Service may offer in-app purchases or subscriptions (for example, a Pro tier or non-consumable content). All such purchases are processed by Apple (App Store) or Google (Google Play) under their respective terms. Refunds, billing disputes, and cancellation are handled by the relevant app store. We do not directly process payment cards.

9. Third-Party Services

The Service relies on third-party providers (such as Cloudflare, Apple, Google, Resend, PostHog, Sentry, and OpenAI) listed in our Privacy Policy. Your use of those services through Trivia Gorilla is also subject to their own terms.

10. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant the accuracy of any quiz content.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will Trivia Gorilla, Mishigo OU, or its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising from these Terms will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, abuse the Service, or for any other legitimate reason. You may stop using the Service at any time and delete your account as described in Section 4. The sections of these Terms that by their nature should survive termination (e.g., Sections 7, 10, 11, 13) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws rules. The courts of Estonia have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except where mandatory consumer-protection laws of your country of residence give you the right to bring proceedings in your local courts.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above and, where the change is material, notify you in-app or by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
